These Terms of Use ("Terms") govern your access to and use of the 256 Wellness mobile application and related services (the "App"), developed and operated by Bussinapps Pty Ltd ("we", "us", or "our").

By using the App, you confirm that you have read, understood, and agreed to be bound by these Terms and our [Privacy Policy]. If you do not agree to these Terms, you must not use the App.

1. Eligibility

You must be at least 18 years old or have the consent of a parent or guardian to use this App. By using the App, you represent and warrant that:

Subscriptions auto-renew unless canceled through your platform’s settings.

You may cancel at any time, but partial refunds are not issued unless required by law.

4. Wellness Content Disclaimer

The App provides personalized wellness guidance, including:

Meal plans

Exercise and movement routines

Mindfulness and mental well-being practices

We are not a medical provider. No part of the App constitutes medical advice.

Content is for informational and educational purposes only.

You should consult a qualified healthcare professional before beginning any plan, especially if pregnant, nursing, or managing a medical condition.

5. Acceptable Use

You agree not to:

Use the App for any unlawful or harmful purpose.

Circumvent or attempt to gain unauthorized access to systems or data.

Copy, modify, or redistribute content without our permission.

Upload viruses, malware, or disruptive code.

Misrepresent your identity or impersonate others.

We may terminate access for users who breach this section.

6. Intellectual Property

All content and technology associated with the App, including branding, code, designs, and media, are the property of Bussinapps Pty Ltd or its licensors.

You are granted a non-exclusive, non-transferable, revocable license to use the App for your own personal, non-commercial purposes, subject to these Terms.

7. Data Protection and Privacy (Including GDPR Compliance)

Upon termination:

Your license to use the App is revoked

Your local data will remain on your device until deleted

Any cloud-based metadata may be deleted, subject to legal obligations

10. Disclaimers

To the fullest extent permitted by law, the App and all content are provided “as is” and “as available” without any warranties or guarantees, including:

Fitness for a particular purpose

Non-infringement

Continuity or availability of the service

Accuracy or completeness of information

We do not guarantee any health, fitness, or wellness outcome from using the App.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

We are not liable for indirect, incidental, or consequential damages.

Our total liability shall not exceed the total amount paid by you in the last 12 months.

Nothing in these Terms excludes liability that cannot be excluded by law, such as liability for fraud or death caused by negligence.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Victoria, Australia, without regard to conflict of law principles.

If any dispute arises, you agree to submit to the exclusive jurisdiction of the courts of Victoria, Australia.
